Application mobile - Contrat d'Utilisateur Final

1. This Agreement ("the App Agreement") applies to the downloading and use of iDealing software for mobile devices, including any information contained therein.

2. iDealing.com Limited ("we", "us" or "iDealing") hereby grant you a non-exclusive, non-transferable, non-assignable licence ("The license") to download and use our mobile trading software application ("the App"), provided that you are an existing customer of iDealing, who has agreed to all of our additional Terms and Conditions, Risk Warnings, and Services and Prices (together, "the Terms and Conditions") and relating to our brokerage services that we make available to you, as amended from time to time.

3. All of the Terms and Condition area available on our website, www.idealing.com.

4. The license and use of the App is subject at all times to the Terms and Conditions.

5. The license and may be withdrawn at anytime without notice, and is subject to the additional following restrictions/obligations:

5.1 the use of the App may be withdrawn or restricted at anytime and without notice;

5.2 the App is not intended for distribution or use by any person in any jurisdiction or country where such use and/or distribution would be contrary to local laws and/or regulations;

5.3 you shall not copy or reproduce in any way the whole or any part of the App;

5.4 you shall not alter, modify or adapt the whole or any part of the App;

5.5 you may only use the App for the purposes of accessing the services that iDealing provides;

5.6 you acknowledge and agree that all ownership, title, rights and any intellectual property in the App remains with iDealing.com Ltd;

5.7 the License is only for you, and you shall not assign, sub-license or grant any rights of use or any other rights in respect of the App to any other person;

5.8 you agree to compensate us in respect of any damages suffered by us or any losses incurred by us as a result of a claim from any third party in relation to any matters arising due to your use of the App which are in breach of the App Agreement or as a result of your violation of any applicable laws or regulations;

5.9 you shall not use the app in any way that may lead to the encouragement, procurement or carrying out of any unlawful or criminal activity or which may cause any harm, distress or inconvenience to any person. Furthermore, you may not cause damage to any of the websites, servers, systems or equipment used in the provision of the App by iDealing or any other third party and you may not attempt to penetrate any of the security measures relating to the App; and 5.10 on termination of this Agreement all rights granted to you in relation to the App shall immediately come to an end.

6. Your mobile device network 5.4 vous n'altérerez pas, ne modifierez pas ou n'adapterez pas l'Application en tout ou partie ;operator may charge you when using the App and these charges may vary if you access or use the App abroad. You are solely responsible for these charges and iDealing may not be held liable for these or any other third party charges relating to the use of the App.

7. iDealing does not make any representations as to the availability or performance of the App and does not guarantee either. You agree that when you use the App you do so at your own risk.

8. The terms of this agreement may be amended at any time without notice, and the use of the App may be made conditional upon acceptance of additional terms.

9. In the event that there are any inconsistencies between this agreement and our Terms and Conditions, the Terms and Conditions shall prevail.

10. Failure to comply with the terms and conditions set out in the App Agreement may result in suspension or termination of the App Agreement or to the App itself.

11. If any provision of the App Agreement is held to be invalid or ineffective it will not affect the enforceability or validity of any other provisions.

12. The App Agreement is governed by English law and both parties agree to submit to the non-exclusive jurisdiction of the English courts.

1. Le présent Contrat (« le Contrat sur les Applications ») porte sur le téléchargement et l'utilisation du logiciel iDealing pour les appareils mobiles, y compris toute information contenue dans celui-ci.

2. iDealing.com Limited (« nous » ou « iDealing ») vous accorde par la présente une licence non-exclusive, non-transférable et non-cessible (« la Licence ») pour télécharger et utiliser notre application logicielle de commerce mobile (« l'Application »), à condition que vous soyez un client existant de iDealing, et que vous ayez accepté l'ensemble de nos conditions générales complémentaires, avertissements sur les risques, services et tarifs (conjointement, « les Conditions Générales »), ainsi que la licence relative aux services de courtage que nous mettons à votre disposition, tels que modifiés de manière occasionnelle.

3. Les Conditions Générales sont intégralement disponibles sur notre site web, www.idealing.com.

4. La licence et l'utilisation de l'Application sont soumises à tout moment aux Conditions Générales.

5. La licence peut être retirée à tout moment sans notification préalable, et est soumise aux restrictions/obligations complémentaires suivantes :

5.1 l'utilisation de l'Application peut être retirée ou limitée à tout moment et sans notification préalable ;

5.2 l'Application n'est pas destinée à être distribuée à, ou utilisée par toute personne dans tout territoire ou pays si une telle utilisation et/ou distribution est contraire à la législation et/ou aux réglementations locales ;

5.3 vous ne copierez ou ne reproduirez d'aucune manière l'Application en tout ou partie ;

5.4 vous n'altérerez pas, ne modifierez pas ou n'adapterez pas l'Application en tout ou partie ;

5.5 vous pouvez uniquement utiliser l'Application aux fins d'accéder aux services fournis par iDealing ;

5.6 vous reconnaissez et acceptez que toute propriété, titre, droit et toute propriété intellectuelle de l'Application reste la possession de iDealing.com Ltd ;

5.7 la Licence vous est uniquement destinée, et vous ne céderez pas et n'accorderez pas, en sous-licence ou autrement, tous droits d'utilisation ou tous autres droits liés à l'Application à quiconque ;

5.8 vous acceptez de nous dédommager en cas de préjudices subis par nous ou de pertes encourues par nous à la suite d'une demande d'indemnisation présentée par tout tiers en rapport avec tous problèmes survenant en raison de votre utilisation de l'Application en violation du Contrat sur les Applications, ou à la suite d'une violation de votre part de toute législation ou réglementation applicable ;

5.9 vous n'utiliserez pas l'application d'une quelconque manière pouvant conduire à encourager, inciter à, ou réaliser toute activité illégale ou criminelle, ou pouvant occasionner à toute personne toute nuisance, difficulté ou dérangement. En outre, vous ne pouvez pas endommager un quelconque site web, serveur, système ou équipement utilisé dans la mise à disposition de l'Application par iDealing ou par tout autre tiers, et vous ne pouvez pas tenter de contourner l'une quelconque des mesures de sécurité associées à l'Application ; et

5.10 au terme du présent Contrat, tous les droits qui vous sont accordés en rapport avec l'Application prendront immédiatement fin.

6. L'opérateur réseau de votre appareil mobile peut vous facturer l'utilisation de l'Application, et les frais correspondants peuvent varier si vous accédez à, ou utilisez l'Application depuis l'étranger. Vous êtes le seul responsable de ces frais et iDealing ne saurait être tenu responsable de ceux-ci ou de tous autres frais de tiers liés à l'utilisation de l'Application.

7. iDealing ne fait aucune déclaration quant à la disponibilité ou à l'exécution de l'Application, et ne garantit ni l'une ni l'autre. Vous reconnaissez que vous utilisez l'Application à vos propres risques.

8. Les termes du présent contrat peuvent être modifiés à tout moment sans notification préalable, et l'utilisation de l'Application peut être subordonnée à l'acceptation de conditions supplémentaires.

9. En cas de contradictions entre le présent contrat et nos Conditions Générales, ces dernières prévaudront.

10. Le manquement aux conditions générales énoncées dans le Contrat sur les Applications peut entraîner la suspension ou la résiliation de celui-ci, voire de l'Application elle-même.

11. Si une quelconque disposition du Contrat sur les Applications est considérée nulle ou sans effet, cela n'affectera pas l'applicabilité ou la validité de toutes autres dispositions.

12. Le Contrat sur les Applications est régi par le droit anglais et les deux parties conviennent de se soumettre à la compétence non-exclusive des tribunaux anglais.

1. Deze overeenkomst ('de app-overeenkomst') is van toepassing op het downloaden en gebruiken van iDealing-software voor mobiele apparaten, inclusief de informatie erin.

2. iDealing.com Limited ('wij', 'ons' of 'iDealing') verleent u hierbij een niet-exclusieve, niet-overdraagbare, niet-toewijsbare licentie ('de licentie') voor het downloaden en gebruiken van onze mobiele handelsapp ('de app'), op voorwaarde dat u een bestaande cliënt bent van iDealing, die heeft ingestemd met al onze aanvullende algemene voorwaarden, waarschuwingen in verband met risico's en services en prijzen (samen, 'de algemene voorwaarden') en betreffende onze makelaarservices die we aan u leveren, zoals deze op enig moment luiden.

3. U vindt alle algemene voorwaarden op onze website, www.idealing.com.

4. De licentie en het gebruik van de app zijn op elk moment onderworpen aan de algemene voorwaarden.

5. De licentie kan op elk moment zonder voorafgaande kennisgeving worden ingetrokken en is onderworpen aan de volgende aanvullende beperkingen/verplichtingen:

5.1 het gebruik van de app kan op elk moment en zonder kennisgeving worden ingetrokken of beperkt;

5.2 de app is niet bedoeld voor verspeiding of gebruik door personen in een rechtsgebied of land waar een dergelijk gebruik/een dergelijke verspreiding een inbreuk zou vormen op de lokale wetten en/of regelgeving ;

5.3 u mag de app noch geheel noch gedeeltelijk kopiëren of reproduceren;

5.4 u mag de app noch geheel noch gedeeltelijk veranderen, wijzigen of aanpassen;

5.5 u mag de app alleen gebruiken om toegang te krijgen tot de services die iDealing aanbiedt;

5.6 u erkent en accepteert dat alle eigendomsrechten, titels, rechten en intellectuele eigendomsrechten van de app de eigendom van iDealing.com Ltd blijven;

5.7 de licentie is alleen voor u, en mag niet worden toegewezen, gesublicentieerd noch mogen er gebruiksrechten of andere rechten betreffende de app worden toegewezen aan andere personen;

5.8 u gaat ermee akkoord om ons te vergoeden voor alle schade of verliezen geleden door ons naar aanleiding van een claim van een derde partij betreffende alle aangelegenheden die voortvloeien uit uw gebruik van de app, die een inbreuk vormen op de app-overeenkomst of naar aanleiding van een inbreuk door u op de toepasselijke wetten of regelgeving;

5.9 u mag de app niet gebruiken op een manier die kan leiden tot aanmoediging, bewerkstelliging of uitvoering van onwettige of criminele activiteit of activiteit die kan leiden tot schade, leed of ongemak voor personen. Bovendien mag u geen schade berokkenen aan de websites, servers, systemen of uitrustingen die iDealing of een derde partij gebruikt voor de app en u mag niet proberen de veiligheidsmaatregelen in verband met de app te omzeilen; en 5.10 bij beëindiging van deze overeenkomst zullen al uw rechten op de app onmiddellijk komen te vervallen.

6. De netwerkprovider van uw mobiele apparaat kan kosten aanrekenen wanneer u de app gebruikt en deze kosten zijn afhankelijk van of u de app in het buitenland opent of gebruikt. U alleen bent verantwoordelijk voor deze kosten en iDealing kan niet aansprakelijk worden gehouden voor deze kosten of kosten van andere derde partijen betreffende het gebruik van de app.

7. iDealing spreekt zich niet uit over de beschikbaarheid of prestaties van de app en levert ook geen garantie in dit opzicht. U stemt ermee in dat u de app op eigen risico gebruikt.

8. We kunnen de bepalingen van deze overeenkomst op elk moment wijzigen zonder kennisgeving en het gebruik van de app kan worden onderworpen aan de acceptatie van aanvullende bepalingen.

9. Wanneer er inconsistenties bestaan tussen deze overeenkomst en onze algemene voorwaarden, zullen onze algemene voorwaarden voorrang hebben.

10. Wanneer u de bepalingen en voorwaarden in de app-overeenkomst niet naleeft, kan dit leiden tot opschorting of beëindiging van de app-overeenkomst of de app zelf.

11. Wanneer een bepaling van de app-overeenkomst ongeldig of onwerkzaam wordt, zal dat de afdwingbaarheid van de overige bepalingen niet aantasten.

12. De app-overeenkomst wordt beheerd door de Engelse wet en beide partijen gaan ermee akkoord om eventuele geschillen voor te leggen aan de niet-exclusieve rechtsbevoegdheid van de Engelse rechtbanken.
